Revenue publish Defaulters List
Today's (19/03/04) edition of Iris Oifigiúil contains details of published audit /investigation settlements completed by Revenue in the period 1 October 2003 to 31 December 2003.
The list is published in two parts:
Part 1 lists every person upon whom a fine or other penalty was imposed by a court.
This includes the following categories:
- Failure to file a return
- Filing an incorrect return
- Illegal selling of tobacco
- Cigarette smuggling
- Various excise and licensing offences
The total amount of fines and penalties imposed was €355,843.
Prison sentences were imposed in four cases.
Part 2 lists audit settlements where the Revenue Commissioners accepted a specified sum in excess of €12,700 in settlement of any additional liability for tax, interest and penalties instead of instituting proceedings for the recovery of the penalties and where:
- a voluntary disclosure was not made by the taxpayer prior to the commencement of an audit and
- the amount of fine or penalty included in the settlement exceeded 15% of the tax.
In the three month period to 31 December 2003 there were 182 settlements in excess of €12,700 which fall to be published. The settlements in these cases total €25.20 million.
Of the 182 published settlements 62 were for amounts exceeding €100,000. Included in this figure are eight settlements with a yield in excess of €500,000, four of which had a yield in excess of €1,000,000.
Of the 182 settlements:
- 141 settlements totalling €22.25m relate to Bogus Non-Resident holders,
- One settlement totalling €0.58m relates to an Ansbacher account holder,
- One settlement totalling €0.11m relates to Revenue's NIB Investigation.
The total yield from Revenue audits and investigations in the three month period to 31 December 2003 was €78.87 million.
This comprises:
- 25.20 million from 182 published settlements as detailed above
- 33.11 million from 347 settlements with a yield in excess of €12,700 which did not fall to be published
- 20.57 million from 2,561 settlements with a yield of €12,700 or below which did not fall to be published.
