Summary

Mr. Hynes with an address at Shercloon, Raphoe, Clifford, Co Donegal pleaded guilty to the following offences:

  • Knowingly or willfully submitting an incorrect VAT Return for the period November/December 2005 (1 count)
  • Failing to remit VAT for the period January/February 2006 (1 count)
  • Failure to furnish an Income Tax Return for the year 2006 (1 count)
  • Knowingly or willfully producing an incorrect invoice to an authorised officer of the Revenue Commissioners in connection with Value Added Tax (2 counts)

The charges were taken under Section 1078 Taxes Consolidation Act 1997.

Outcome

The court was informed that Mr Hynes had failed to pay €110,000 in respect of VAT for the periods. On the 7th of February at Letterkenny District Court Judge Hughes sentenced Mr Hynes to 9 months imprisonment on the count of producing an incorrect invoice and imposed a fine of €750. The Judge also made an order under Section 1078 (3A) directing that the requirement to file an Income Tax return for 2006 be complied with.
