Summary

Carol Collopy with an address at Danesfort, Corbally, Co. Limerick was charged with the following offences (six counts).

  • Keeping for sale or delivery, on three separate occasions, tobacco products amounting to 36,400 cigarettes and 3.28 kilos of tobacco in packs without a tax stamp affixed. On the 8th May 2012, she pleaded guilty to all six charges. The Court was told that the Ms. Collopy had two previous convictions in 2005 for evasion of excise duty on cigarettes. The revenue at risk on the tobacco products concerned was €10,153.

The above being offences under Section 78 of the Finance Act, 2005.

Outcome

On 15th May 2012 at Limerick Circuit Court, Judge Carroll Moran imposed a two year prison sentence on each of the six charges to run concurrently. In passing sentence Judge Moran commented that the set of charges in respect of the first detection involved a significant quantity of tobacco product and, while there were smaller amounts of tobacco involved in respect of the second and third charges, these were repeat offences and he had no alternative but to sentence Ms. Collopy to two years imprisonment.
