Summary
John Joseph Geaney, with an address at 10 Prosperity Square, Barrack Street, Cork was charged with the following offences (seven counts):
Keeping for sale or delivery tobacco products amounting to 111,200 cigarettes and 124.25 kilos of tobacco in packs without tax stamp affixed and being concerned in the evasion and attempted evasion and taking possession of excisable products.
The Revenue at Risk on the tobacco products concerned was €69,086.
The above being offences under Section 78 of the Finance Act, 2005 and Section 119 of the Finance Act, 2001.
Outcome
At Cork Circuit Criminal Court, on 29th June 2012, Judge Patrick Moran sentenced John Joseph Geaney to 18 months imprisonment for each of the seven charges to run concurrently. A six months suspended sentence from a previous conviction was also reactivated to run consecutively to the other sentences, totalling 24 months imprisonment.
