Summary
On the 18th March 2008 Revenue Enforcement Officers based in Cork detected a total of 13,200 unstamped cigarettes at a retail premises operated by Olga Lamonova, and during a follow up search of her residence.
At Cork City District Court on the 15th April 2009, Ms. Lamonova pleaded guilty to the following offences:
- Keeping for sale or delivery specified tobacco products, to wit 2,600 cigarettes otherwise than in packs to which a tax stamp had been affixed to each such pack contrary to Section 78(3) of the Finance Act 2005 and Section 78(5) of the Finance Act 2005 and amended by Section 82 of the Finance Act 2006.
- Keeping for sale or delivery specified tobacco products, to wit 10,600 cigarettes otherwise than in packs to which a tax stamp had been affixed to each such pack contrary to Section 78(3) of the Finance Act 2005 and Section 78(5) of the Finance Act 2005 and amended by Section 82 of the Finance Act 2006.
Outcome
On the first charge Judge Riordan convicted Ms. Lamonova and imposed a fine of €500, with 3 months to pay, and 45 days in default. On the second charge she was convicted and sentenced to three months imprisonment, suspended on condition that she enter into a bond to keep the peace and be of good behaviour for two years.
