Summary:
On the 6 November 2012 Tralee Circuit Court ordered the forfeiture to the Exchequer of cash amounting to €50,000 pursuant to Section 39, Criminal Justice Act 1994, as amended by Section 21, Proceeds of Crime (Amendment) Act 2005, on the grounds that it was proven on the balance of probabilities to represent the proceeds of crime, or was intended for use in criminal conduct. On 15 October 2010 Revenue Enforcement Officers at Kerry Airport seized and detained the cash from Arshad Hassan as he was about to board a flight to Germany.
When questioned, Mr. Hassan stated he was carrying approximately €50,000, which was concealed in clothing in his hand luggage.
Following an investigation by Revenue’s Investigations and Prosecutions Division a file on the matter was referred to the Director of Public Prosecutions who ordered the forfeiture proceedings.
It had been claimed by Arshad Hassan that he was travelling to Frankfurt Hahn, Germany, that the money was his, that he intended to open a restaurant in Dublin and as the restaurant was not ready that he had collected the money from a man in Killarney and was bringing it back to Germany with him.
Arshad Hassan was not represented at any stage of the Court Applications.
