Summary
On the 29 May 2014, Dundalk Circuit Court ordered the forfeiture to the Exchequer of cash amounting to €27,550 and UK£5,000 pursuant to Section 39, Criminal Justice Act 1994, as amended by Section 21, Proceeds of Crime (Amendment) Act 2005 which had been seized and detained on 27 October 2009 by Revenue Enforcement Officers at John Prendergast Stores, Millpark, Knockbridge, Dundalk, Co Louth.
Following an investigation by Revenue’s Investigations and Prosecutions Division, a file on the matter was referred to the Director of Public Prosecutions who directed the forfeiture proceedings. The application for forfeiture was opposed by Counsel on behalf of John Prendergast, who was in Court. However Judge Reynolds ordered the forfeiture of the cash as she was satisfied that it was proven on the balance of probabilities to represent the proceeds of crime, or was intended for use in criminal conduct.
