Summary
On 9 March 2015 Dublin Circuit Criminal Court ordered the forfeiture to the Exchequer of cash amounting to €11,950 pursuant to Section 39, Criminal Justice Act 1994, as amended by Section 21, Proceeds of Crime (Amendment) Act 2005, on the grounds that it was proven on the balance of probabilities to represent the proceeds of crime, or was intended for use in criminal conduct. On 11 June 2014 Revenue Enforcement Officers at Dublin Airport seized and detained the cash from Kim Louise Hall as she was about to board a flight to Amsterdam, The Netherlands.
Following an investigation by Revenue’s Investigations and Prosecutions Division, a file on the matter was referred to the Director of Public Prosecutions who ordered the forfeiture proceedings.
Ms Hall was travelling with her fiancé Mr Richard Harris. Mr Harris told Customs Officers that he was travelling alone and that he only had €1,200 cash. He proceeded through the boarding gate without acknowledging Ms Hall only to return some time later then claiming that the cash was partially his. Ms Hall consented in writing to the forfeiture of €10,000 of the detained cash. Mr Harris was afforded an opportunity to engage in the proceedings and to make a claim on the cash but he did not and the forfeiture application was unopposed.
