Summary

Adel Eid with an address at Flat 6, Twyford Court, Twyford Avenue, London, W3 9QE, was arrested and charged on 27th January 2009 with the following

  • being concerned in the evasion of a duty on excisable products namely 1,470 kilos of 'waterpipe' tobacco with intent to defraud, the State of such duty contrary to Section 119(1) and (3) of the Finance Act, 2001. The value of the goods concerned was €411,611.

Mr Eid was admitted to bail by recognisance on 10th February 2009 following a High Court application and was due to appear at Cloverhill District Court on 12th February 2009. Mr Eid failed to appear at that sitting and a bench warrant was issued for his arrest. He remained a fugitive until he was arrested in the UK on 13th July 2011 on foot of a European Arrest Warrant (EAW), which was instigated by the Revenue Commissioners, and was returned to Ireland on 26th July 2011 where he was brought before the Court and remanded in custody.

Mr Eid pleaded guilty to the offence in the Circuit Court on 28th October 2011 and was remanded in custody pending sentencing.

Outcome

On 23rd February 2012 at Dublin Circuit Criminal Court, Judge Martin Nolan imposed a custodial sentence of 2.5 years imprisonment, backdated to commence on the date of his arrest under the European Arrest Warrant.

Nolle prosequi was entered in relation to two related charges.
