Summary
David Cagney with an address at 56 Evora Park, Howth, Co. Dublin, pleaded guilty to the following offences under Section 1078 of the Taxes Consolidation Act 1997:
- Delivering an incorrect tax return for the year 2003
- Failing to deliver a return for the years 2010 and 2011 (2 counts)
- Failing to remit VAT for the periods July/Aug 2005, Jan/Feb 2006, Sept/Oct 2006, May/June 2007, Jan/Feb 2008, Sept/Oct 2008, May/June 2009, Jan/Feb 2010, Sept/Oct 2010 and Nov/Dec 2011 (10 counts)
- Knowingly or wilfully furnishing incorrect information in a Tax Registration Form (TR1)
- Claiming a repayment of income tax to which he was not entitled
Outcome
On 16 July 2015 at Dublin Circuit Court, Judge Martin Nolan sentenced Mr Cagney to two years imprisonment in respect of the fifteen counts. He however suspended the sentence in full.
