Summary

Padraic Clarke, Director of Billberry Construction Ltd (now in liquidation), with an address at Skeagh, Bailieborough, Co Cavan, pleaded guilty to the following offences under Section 1078 of the Taxes Consolidation Act 1997:

  • Consent or connivance as a Director of a body corporate in knowingly or wilfully delivering an incorrect VAT return for the period 1 May 2008 to 30 June 2008.
  • Consent or connivance as a Director of a body corporate in knowingly or wilfully delivering an incorrect RCT return for the period September 2007.
  • Consent or connivance as a Director of a body corporate in knowingly or wilfully delivering an incorrect RCT return for the period May 2008.
  • Consent or connivance as a Director of a body corporate in knowingly or wilfully delivering an incorrect RCT return for the period July 2008.

Outcome

On 24 November 2016, at Cavan Circuit Court, Judge O’Hagan sentenced Mr Clarke to 18 months imprisonment in respect of each count, to run concurrently, with the whole sentence substituted by 240 hours of community service. Mr Clarke was also fined €5000 in respect of each count, to be paid over the next five years.
